TAPCARD.BIZ – TERMS OF SERVICE

TapCard.Biz (“TapCard,” “we,” “us,” or “our”) provides digital business card profiles, NFC TapCards, QR codes, lead capture tools, analytics, and related services (collectively, the “Service”). TapCard.Biz is a registered fictitious name (DBA) of JGD Designs LLC, a Florida limited liability company.

By accessing or using the Service, creating an account, purchasing or using a TapCard, or clicking “I Agree,” you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

Acceptance of Terms

By using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. Continued use of the Service after any updates constitutes acceptance of the revised Terms.

Description of the Service

TapCard provides tools to create and manage digital business card profiles, share contact information via NFC taps, QR codes, or links, capture leads, view analytics, and related features. We do not guarantee that every tap or share will function on all devices due to hardware or software limitations.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@tapcard.biz of any unauthorized use.

User Content and Profiles

You retain ownership of the content you upload, including photos, logos, contact details, links, and profile information (“User Content”). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit your User Content as necessary to provide the Service.

You are solely responsible for ensuring that your User Content is accurate, lawful, and does not infringe on the rights of any third party.

Lead Capture and Compliance

When someone taps or scans your TapCard and voluntarily shares their information, that data is delivered to your account. You are solely responsible for how you use that data and must comply with all applicable laws, including but not limited to CAN-SPAM, TCPA, and applicable data privacy regulations.

Prohibited Conduct

  • Use the Service for any illegal, fraudulent, or harmful purpose;
  • Harass, spam, or send unsolicited communications;
  • Reverse engineer, copy, modify, or interfere with the Service;
  • Upload viruses, malware, or infringing material;
  • Create multiple accounts to abuse features or bypass restrictions;
  • Resell or sublicense access to the Service without written permission.

Intellectual Property

All technology, software, branding, and content provided through the Service (excluding your User Content) are owned by or licensed to JGD Designs LLC. You are granted a limited, revocable, non-transferable license to use the Service for its intended purpose.

“TapCard.Biz” and related branding are trademarks of JGD Designs LLC.

Payments and Subscriptions

Payments are processed through third-party providers. Fees are non-refundable except where required by law or stated otherwise. Subscription services, if offered, will renew automatically unless canceled prior to the renewal date.

We reserve the right to modify pricing with reasonable notice.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease.

Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, JGD Designs LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Indemnification

You agree to indemnify, defend, and hold harmless JGD Designs LLC from any claims, damages, liabilities, losses, and expenses (including reasonable attorney’s fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

Third-Party Services and Links

The Service may include links to or integrations with third-party services. We are not responsible for the content, policies, or practices of those third parties.

Export Compliance

You agree to comply with all applicable U.S. export laws and regulations in connection with your use of the Service and any related products.

Updates to These Terms

We may update these Terms from time to time. Updated versions will be posted with a revised “Last Updated” date. Continued use of the Service constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Arbitration Agreement

Any disputes arising from or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except for matters eligible for small claims court.

You waive any right to a jury trial or participation in a class action lawsuit. Arbitration will be conducted in accordance with the rules of the American Arbitration Association.
